Apparently the issue of whether a breach of license is a copyright violation or a contractual breach is not new in France and it is usually deemed copyright violation but it depends on the specific case.
This case does not actually seem to settle the issue, and the court seems to have concluded that the plaintiff was seeking damages for a breach of contract, and not for copyright violation.
